MILWAUKEE PURCHASE LUCKY DRAW TERMS AND CONDITIONS

1. TERMS AND CONDITIONS

1.1 These terms and conditions (“Terms and Conditions”) apply to the MILWAUKEE PURCHASE LUCKY DRAW (“Lucky Draw”) that we, Milwaukee Tool Hong Kong, organise.

1.2 By participating in this Lucky Draw, you agree to accept these Terms and Conditions.

2. LUCKY DRAW DETAILS

2.1 The enrolment period of the Lucky Draw starts on 28th January 2023 and ends at 7:00 pm on 21st April 2023 (both days inclusive) (“Enrolment Period”).

2.2 During the Enrolment Period, you will be assigned a lucky draw ticket (“Ticket”), which includes a lucky draw code (“Code”), in two ways:

2.2.1 You will be assigned (i) one ticket for making any single purchase at or over HK$3,000, (ii) two tickets for making any single purchase at or over HK$6,000, and so on; or

2.2.2 You will be assigned (i) one ticket for making purchase of any one of the specific combo (see below APPENDIX A), (ii) two Tickets for making purchase of any two of the specific combo kits (see below APPENDIX A), and so on, in our E-shop (www.milwaukeetool.com.hk), or at the Milwaukee™ Tool HEAVY DUTY CENTER stores in Mong Kok and in Yuen Long.

2.2.3 Ticket award condition mentioned in 2.2.1 and 2.2.2 are non- mutually exclusive. (Example: Customer purchase 1 specific combo in appendix A and reach $3,000 in a single order, he/she will be entitle to get 2 lucky draw tickets)

2.3 Only one Code will be included in each Ticket. There is no limitation on the number of Tickets/Codes you can obtain. Each participant can only win once at most in the Lucky Draw.

2.4 Participants will need to fill in their personal information in the application form which can be accessed by scanning the QR code on the Ticket, the name to be provided in the application form shall be identical to HKID and put the Ticket stub into the lucky draw boxes at the Milwaukee™ Tool HEAVY DUTY CENTER stores in Mong Kok and in Yuen Long to complete the enrolment in the Lucky Draw (“Enrolment”). The deadline for Enrolment is 7:00 pm on 21st April 2023.

2.5 Employees of Milwaukee Tool Hong Kong are not eligible to participate in the Lucky Draw.

2.6 You must be aged 18 or above and hold a valid Hong Kong Identity Card in order to be eligible to enter the Lucky Draw.

2.7 The winners of the Lucky Draw will be drawn on 28th April 2023 by drawing ticket stub randomly.

2.8 The winners of the Lucky Draw will be announced through the following channels:

2.8.1 our Facebook page (https://www.facebook.com/MilwaukeeToolHK/) and website (https://www.milwaukeetool.com.hk/en/events/milwaukee-purchase-lucky-draw/) on or before 5th May 2023; and

2.8.2 The Standard (in English) and Sing Tao Daily (in Chinese) on 5th May 2023.

3. PRIZES & REDEMPTION ARRANGEMENT

3.1 Prizes for the Lucky Draw are as follows:

3.2 Winners of the Lucky Draw are required to contact us at email address: Enquiry@milwaukeetool.com.hk on or before 10th May 2023.

3.3 All prizes must be claimed in person by the winners on or before 31st May 2023 (“Collection Period”) at the redemption site notified to the winners. Winners who do not collect their prizes within the Collection Period will be deemed to have forfeited his/her entitlement to the prizes and no compensation shall be made by Milwaukee Tool Hong Kong.

3.4 Winners are required to present Ticket which clearly shows the Code and present an original identification document as proof of identity at redemption. We will not be responsible for any damaged, lost or stolen Ticket and will not re-issue the same. We may ask you for your mobile number and email address for verification and prize redemption purposes. Prizes will be automatically forfeited without compensation if there is any discrepancy between the personal information entry on the application form and the information upon verification at redemption.

3.5 All prizes in this Lucky Draw cannot be refunded, redeemed, transferred or exchanged for cash.

3.6 We are not liable for any responsibilities regarding use or enjoyment of the prizes.

3.7 We reserve the right to disqualify any participant or winner without any notice on the grounds of non-compliance with or breach of any of these Terms and Conditions.

4. MISCELLENOUS

4.1 If any participant violates any rules or commit any illegal acts that result in any losses on the part of us or any third parties, the relevant participant will be liable for all the losses and we reserve all legal rights to recover damages or other compensation from the relevant participant.

4.2 We will not be liable for any matter or loss in relation to any computer or internet network issues. All dates and time related to the Lucky Draw are recorded according to the reception of our server and computer records.

4.3 If you have consented to receiving direct marketing information, all personal data collected by the Lucky Draw will be used for direct marketing purposes as set out in our privacy policy available at https://www.milwaukeetool.com.hk/en/privacy-policy.

4.4 Any failure by us to enforce any one of the Terms and Conditions in any instances will not give rise to any claim or right of action by the participants or winners, nor shall it be deemed to be a waiver of any of our rights in relation to the same.

4.5 The provisions contained in each clause of these Terms and Conditions shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of these Terms and Conditions is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

4.6 A person who is not an eligible participant in the Lucky Draw has no right at law to enforce any of these Terms and Conditions. For the avoidance of doubt, no person other than Milwaukee Tool Hong Kong and eligible participants will have any rights or benefits from these terms and conditions under the Contracts (Rights of Third Parties) Ordinance (Cap 623).

4.7 These Terms and Conditions shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). You hereby irrevocably submit to the non-exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with these Terms and Conditions.

4.8 These Terms and Conditions are prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.

4.9 In case of any dispute, we reserve the right of final decision.
